K9 Ballistics - Terms & Conditions

All Affiliates participating in the K9 Ballistics Affiliate Program (the “Program”) are subject to the terms and conditions described in this document. Affiliates shall be referred to as "Publishers" for the remainder of this document.

Violations of the Terms and Conditions

Violating the terms and conditions of the K9 Ballistics Affiliate Program (the “Program”) places our brand at immediate risk. Because we are extremely protective of our brand, we ask that Publishers adhere strictly to these requirements. Publishers who violate the below-mentioned terms and conditions will immediately and permanently be removed from the Program. There is no appeal from such removal.

Brand Representation

Publishers may not represent themselves as K9 Ballistics. Websites, widgets, applications, and iPhone applications must be approved by a K9 Ballistics manager before they can be used to promote K9 Ballistics.

Minimum Advertised Price (MAP) Policy

By participating in the Program, Publishers agree to abide by the K9 Ballistics MAP policy.

Publishers must only show prices that we provide in our data feed or show on our product page. No prices may be pulled from other sources.

This MAP policy is a comprehensive policy and applies anywhere online, including, but not limited to: affiliate sites, forums, newsletters, emails, paid search engines, shopping portals, and social networking sites (like Twitter, Facebook, Blogs).

Promoting Sales

K9 Ballistics may have periodic sales.

If approved by K9 Ballistics, Publishers may promote our sales but must include the sale end date in all advertisements.

Sale information must be removed as soon as that sale ends.

Specific products may never be featured during these sales unless prior written approval has been granted by K9 Ballistics.

Publishers must only show prices that we provide in our data-feed or show on our product page. No prices may be pulled from other sources. (Must always show UMAP List Price for UMAP Products)

Promotional Codes, Coupons, Creative

Publishers agree not to utilize, advertise, or otherwise promote, any K9 Ballistics promotional code or coupon not made available to the Publisher through the K9 Ballistics Interface for the purposes of this publisher relationship without K9 Ballistics prior written approval.

Publishers agree to only use creative tools that are provided through K9 Ballistics.

Cookie Policy

The last referring URL with an attached cookie for marketing campaign tracking will be given credit for an affiliate referral, regardless of the channel. Credit will only be given to the last referring channel/website at the time of conversion. All decisions are final and are determined by K9 Ballistics.

The maximum cookie duration is 30 days.

Domain Names and URLs

Publisher websites must use unique URLs (including subdomain and URL path) that do not contain the K9 Ballistics name, brand names or any misspellings or variations of our name. The use of our name or variations in URLs is prohibited.

Bidding on Pay per Click Search Engines

Publishers shall not bid on the K9 Ballistics name, common misspellings or variations of our brand name, on any pay-for-placement search engine, including but not limited to Google AdWords, Yahoo Sponsored Search or MSN ad Center.

Publishers shall not include 'broad match' K9 Ballistics keywords in a negative keyword list.

Publishers shall not use the K9 Ballistics name in the display URL on any search engine.

Publishers making use of paid search marketing shall use a page within their own websites as landing pages for the advertisements. Publishers shall not send paid search engine traffic directly to the K9 Ballistics website.

Publishers shall not use the K9 Ballistics brand name in meta tags.

Publishers agree that ad copy shall not misrepresent the relationship between the Publisher and K9 Ballistics.

Publishers agree that ad copy shall not contain misspellings, incorrect grammar or false statements such as "Free Shipping on every order" or "No Tax".

Publishers agree not to post anything in the ad copy that alludes to the fact or contains the words or tagline that: "We compete on price, period."

Publishers shall not use claims such as “authorized dealer” or “official store” in the ad copy.

Publishers shall only show prices that we provide in our data-feed or show on our product page. No prices may be pulled from other sources.

International Search Policy

Publishers shall not bid on any keywords or direct links through search in foreign languages on any search engine.

Comparison Shopping

Publishers shall not submit data feeds directly to any comparison shopping portal.

Data feeds

Only data-feeds from K9 Ballistics shall be used (and only with prior approval).

Data-feeds are to be used only on approved Publisher websites with approved URL addresses, and no other websites.

Publishers shall not feed data to other websites, or allow other websites to scrape a data-feed containing K9 Ballistics content or data.

Publishers shall not provide a data-feed to any publisher network, syndicate partner group, CSE, and willfully and completely suppress any data-feed of K9 Ballistics data and content if Publisher has such a network.

In limited circumstances, K9 Ballistics may, in its sole discretion, allow limited data-feeds of its data and content, with specific brands or items excluded as identified by K9 Ballistics.

Publishers may not submit any of K9 Ballistics data-feeds to any shopping portal including, but not limited to: Froogle, Nextag, Yahoo Shopping, Shopzilla or Google Base as stated in their terms of service.

Content

Publishers shall not use K9 Ballistics content (including but not limited to reviews, copy, and images) unless it is provided in a data-feed or approved in writing by K9 Ballistics Program managers. Because our content is produced entirely in-house, Publishers may not utilize K9 Ballistics content on any page that promotes any other company.

K9 Ballistics content, images, reviews, and copy are exclusive to K9 Ballistics and may only be used to promote K9 Ballistics.

Pop-Up, Pop-Under, Re-Directs, and Software

Publishers shall not use site re-directs, pop-ups or pop-unders that link to K9 Ballistics.

Spam and Electronic Messages

Under no circumstances shall Publisher send commercial electronic mail messages as defined in the new Federal spam law, the CAN-SPAM Act of 2003 [the "Act"], with respect to the Program. For clarification, this does not prohibit Publisher from sending transactional or relationship messages as defined in the Act. In addition, except as expressly authorized by K9 Ballistics, any and all electronic messages initiated or sent by Publisher or on Publisher’s behalf must identify Publisher as the sender and may not suggest or imply, or mislead or be likely to mislead a recipient into believing that K9 Ballistics is the sender or sponsor of, or has procured Publisher to send, such electronic messages. By way of clarification, Publisher may not use a return address, subject heading, header information or message contents that misleads or confuses or is likely to mislead or confuse a recipient as to Publisher being the sender.

All electronic messages sent by Publishers representing K9 Ballistics must be approved in writing prior to sending.

Adult Content and Other Unacceptable Content

Publisher shall not post adult-oriented content on any page where K9 Ballistics content appears. K9 Ballistics considers content to be "adult" if it contains nudity or obscenity, or sexually explicit, pornographic, or lewd material. Publisher may not post any offensive content or incorporate images or content that is in any way harmful, threatening, obscene, harassing or racially, ethnically or otherwise objectionable, or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
